§ 2.503. Notification and Appeal of a Vicious Animal Designation

  • (a)

    Within five (5) working days of determining an animal vicious, the animal control manager will notify, by certified mail, return receipt requested, the person owning the animal of its designation as a vicious animal. The notice shall contain a statement that the owner/harborer has a right to appeal. If certified mail cannot be delivered or is refused, the animal control manager may give notice by ordinary mail to the last known address of owner. Written notification may also be delivered by the animal control division in person to the owner/harborer of the animal in question.

    (b)

    If the animal in question is determined to be vicious under this article, the owner may appeal the decision of the animal control manager to the municipal court within ten (10) days of notification. Failure to appeal the determination of vicious animal shall result in the animal control manager's determination becoming final.
