§ 2.502. Determination

  • A determination that an animal is a vicious animal shall be based on the following:

    (1)

    An animal is automatically determined to be a vicious animal if it commits acts as defined in the definition of the term "vicious animal" found in section 2.101;

    (2)

    The owner of a determined dangerous animal under article 2.6 of this chapter, cannot or will not comply with the requirements set out in this article for keeping of a dangerous animal; or

    (3)

    If the animal control manager determines that the animal is vicious, he shall make a disposition determination based on the necessity to preserve the public health, safety and welfare of the community. This determination shall be one of the following:

    a.

    Humane destruction of the vicious animal.

    b.

    Order any owner or person having care, custody, or control of any vicious animal to take such animal permanently from the city.
