§ 2.504. Status of Animal Pending Appeal

  • Pending the outcome of the appeal to municipal court, the animal must be confined at the city animal shelter, the cost of which shall be borne by the owner. If the animal in question is not in the care and custody of the animal control division at the time of the declaration, the owner must surrender the animal to the animal control division when ordered to do so by any animal control officer or police officer. If the owner fails to immediately surrender the animal, the animal control division shall have the right to take the animal into its possession from the premises of the owner or elsewhere, wherever the animal may be found within the city limits. If the animal cannot be taken into custody by the animal control division, it may be taken into custody under a search warrant issued by the municipal judge in the interest of public safety.
