§ 5.05. Tie Vote

  • In the event there is an equal number of votes given to two (2) or more of the candidates receiving the highest vote for the same office, such candidates may, by agreement in writing and filed with the city secretary, draw lots to determine the winner; if both or all such candidates are present. If the candidates receiving the equal number of votes do not agree to draw lots within ten (10) days after the votes are canvassed, the council shall order a tie breaking election between the two (2) or more candidates who have tied.
