§ 7.501. Definitions

  • For the purposes of this article, the following words shall have the meanings ascribed to them by this section:

    Antique motor vehicle means any passenger car or truck that was manufactured in 1925 or before, or which becomes thirty-five (35) years or more old.

    Collector means the owner of one (1) or more antique or special interest vehicles who collects, purchases, acquires, trades, or disposes of special interest or antique vehicles or parts of them for personal use in order to restore, preserve, and maintain an antique or special interest vehicle for historic interest.

    Junked motor vehicle means any motor vehicle, as defined in Section 1 of V.T.C.S., Art. 4477-9a, Sec. 5.01, and motorboats, outboard motors or vessels subject to registration under Chapter 31, Texas Parks and Wildlife Code, that is:

    (1)

    Is inoperative; and

    (2)

    Does not have lawfully affixed to it either an unexpired license plate or a valid motor vehicle safety inspection certificate, and which is wrecked, dismantled, partially dismantled, or discarded; or

    (3)

    Remains inoperable for a continuous period of more than forty-five (45) days.

    Exceptions. The provisions of this article applicable to junked motor vehicles shall not apply to:

    (a)

    Any motor vehicle in operable condition specifically adapted or constructed for racing or operation on privately owned drag strips or raceways.

    (b)

    Any motor vehicle stored as the property of a member of the armed forces of the United States who is on active duty assignment.

    Special interest motor vehicle means a motor vehicle of any age which has not been altered or modified from original manufacturer's specifications and, because of its historic interest, is being preserved by hobbyists.
