§ 2.105. Limitation on Number of Animals

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Adult animal means any animal that is more than six (6) months of age.

    Litter means one (1) or more newborn animals less than six (6) months of age.

    (b)

    Animal limitations. It shall be unlawful for any person to keep within the city, in any residential district, more than four (4) adult animals on a residential lot of ten thousand (10,000) square feet or less; provided, however, that such person may keep one (1) additional adult animal for each additional five thousand (5,000) square feet of lot area. Each residence owner or occupant shall be permitted to keep one litter only.

    (c)

    Special permit. Notwithstanding the provisions of this section, any person who desires to keep additional animals in a residential area shall apply to the animal control manager for a special permit to keep the same. The applicant shall provide the animal control manager with satisfactory proof from the joining property owners within one hundred fifty (150) feet that they have no objection to the issuance of the special permit. The applicant shall pay a fee as listed in Appendix C to this Code of Ordinances for such permit. The special permit shall expire one (1) year from the date of its issuance. The animal control manager shall promulgate rules and regulations that govern the issuance of such special permits.
