§ 5.114. Suspension of personnel

  • The chief of the fire department shall have the exclusive right to suspend any of the officers or employees who may be under his/her control and management for incompetence, neglect of duty, immorality, drunkenness, or failure to obey orders given by the proper authority. If any officer or employee be suspended, the chief of the fire department shall certify the fact, in writing, together with the cause of the suspension, to the city manager, who shall, within five (5) days from the receipt of such certificate, if demanded by the suspended employee, proceed to inquire into the cause of the suspension and render judgment thereon. Such judgment, if the charge be sustained, may be suspension, reduction in rank, or dismissal, and such judgment shall be final. In any such investigation, the power to administer oaths and secure the attendance of witnesses, and the production of books and papers shall exist in favor of the fire chief, the city manager, mayor, council committee or the suspended member.
