§ 2.505. Disposition

  • (a)

    If the municipal court upholds the determination by the animal control manager, the court shall order the vicious animal to be euthanized in a safe and humane manner at the city animal shelter.

    (b)

    The court may uphold the determination by the animal control manager and order the vicious animal be removed from the city limits permanently.

    (c)

    If the owner or harborer of a vicious animal agrees with the determination of the animal control manager to remove the vicious animal from the city limits, or the court upholds the animal control manager's determination, the owner or harborer will not be returned custody of the animal until written information is provided to the animal control division of the location where the vicious animal will be taken, and the owner reimburses the city for any veterinary medical treatment administered to such animal while in the custody of the animal control division.

    (d)

    If the owner has met the requirements as described in subsection (c) of this section, the vicious animal shall be released to its owner, and the owner shall immediately remove such animal from the city limits. A city police officer may follow the owner to the city limits to ensure that the vicious animal is taken from the city.

    (e)

    If the municipal court reverses or modifies the determination, the animal in question shall be released to its owner, provided that the owner reimburses any shelter fees or veterinary expenses while such animal was in custody of the animal control division.
