§ 2.400. Livestock Regulations

  • (a)

    It shall be unlawful for any person to allow livestock to be at large on private or public property. Any livestock at large, within the city limits shall be reported to the sheriff of Montague County or the animal control as soon as reasonably possible, in accordance with county and state laws.

    (b)

    It shall be unlawful for any person to keep livestock in an area zoned residential on any lot having an area less than one (1) acre. A minimum of one-third ( 1/3 ) of that acre shall be set aside for exclusive use by the livestock and no more than two (2) livestock shall be kept in that area. For each one (1) additional livestock an owner must have an additional five thousand (5,000) square feet of available space and this additional square footage will be in addition to the one (1) acre required for keeping livestock.

    (c)

    Livestock must not be located closer than one hundred fifty (150) feet distance from any person's living quarters, other than his own, unless located on a lot of at least two (2) acres.

    (d)

    The provisions of subsection (c) of this section shall not apply to livestock kept on property adjacent to any newly constructed development, provided that the owner can substantiate to the animal control manager that livestock was maintained on the property prior to construction of the new development and so long as the livestock are continuously maintained after construction.

    (e)

    It shall be unlawful for any person to keep on their premises any livestock without providing adequate fences or barriers that will prevent such livestock from escaping and/or damaging neighboring flowers, trees, shrubbery and/or other property located on adjacent property.

    (f)

    The provisions of subsections (b) and (c) of this section shall not become applicable to property or acreage annexed into the city for a period of twelve (12) months after adoption of an annexation ordinance on that property.

    (g)

    It shall be unlawful for any person, other than a veterinarian, to keep any live swine within the city.
