§ 1.1403. License for Rental Boats

  • (a)

    Required. Each year prior to September first, every person who shall rent or offer to rent any boat, or furnish the same for use upon the waters of Lake Amon G. Carter, shall first apply for a license so to do from the police department, upon forms furnished by such department. No boat shall be rented or offered for rent until such license has been granted and the boat marked as hereinafter provided.

    (b)

    Fee. The fee for a license required by this section shall be five dollars ($5.00) for each boat specified in subsection (a) of this section.

    (c)

    Determination of passenger capacity. The police department shall prescribe methods of inspection to determine passenger capacity for each rental boat and to determine that such boat is of suitable structure for the service in which it is to be employed and is in a condition to warrant the belief that it may be used in navigation with safety to life.

    (d)

    Inspections. It shall be the duty of the police department to cause boats coming under this section to be inspected upon application of license, and to see that all boats comply with the prescribed standards. Whenever it shall be found that any boat so inspected does not comply with such standards, it shall be the duty of the police department to notify the owner, proprietor or agent in charge of any such boat, to comply with such standards and with the provisions of this section prior to further use of such boat.

    (e)

    Identification. With the license herein provided for there shall be issued a durable tag or disc for each boat, showing the year of such inspection and such other matters as the police department may deem necessary, which tag or disc must be affixed to some prominent place at bow of boat. There shall also be painted conspicuously on the after quarter the number of passengers authorized to be carried therein, and no owner, his agent or lessor, shall knowingly permit more than that number of passengers to occupy such boat at any time.

    (f)

    Disposition of proceeds. All monies received under this article shall be paid into the city treasury and shall be credited to the general revenue fund.
